These terms explain how Marque Co ("we", "us", "our") works with you ("the client", "you") when you engage us to source a vehicle on your behalf. By instructing us to begin a search, you agree to these terms.
Marque Co acts solely as your agent in sourcing a vehicle. We are not a car dealer and we do not sell vehicles ourselves. We identify, assess, and negotiate on vehicles on your behalf, and introduce you to sellers — but the contract for the purchase of any vehicle is between you and the seller (the dealer, auction house, or private individual), not between you and Marque Co.
Our fee is a sourcing fee for the service of finding, assessing, and negotiating a vehicle on your behalf. It is calculated as 1.5% of the vehicle's advertised price at the time we shortlist it to you, subject to a minimum fee of £400 and a maximum fee of £2,500, unless otherwise agreed with you in writing in advance. Our fee is based on the advertised price, not the final negotiated price — any discount we secure on your behalf is retained entirely by you, and does not reduce or increase our fee.
The £400 minimum fee becomes payable once we deliver a shortlist of vehicles to you, reflecting the work already carried out in searching and vetting on your behalf. This applies whether or not you go on to purchase one of the shortlisted vehicles — including if you decide not to proceed, or purchase a vehicle you have sourced independently. If you do purchase one of our shortlisted vehicles, the £400 already paid counts towards the full sourcing fee due, rather than being charged twice.
Our fee is payable by you, separately from the price of the vehicle, and is not taken from or shared with the seller.
Payment for the vehicle itself is made directly by you to the seller. At no point does Marque Co hold, receive, or handle funds intended for the purchase of the vehicle. We accept no responsibility for payments made directly between you and a seller.
We will search on the basis of the brief you provide to us (budget, requirements, and preferences). We will act reasonably and in good faith to fulfil that brief, but we cannot guarantee that a suitable vehicle will be found within any particular timeframe. Rare, unusual, or classic vehicles may take significantly longer to source, and any realistic timescale will be discussed and agreed with you as part of the brief.
If we are unable to fulfil your brief, we will tell you and discuss next steps with you. We will not charge for work beyond what has reasonably been undertaken at that point, and any further charges will require your agreement.
Because you purchase the vehicle directly from the seller, your statutory consumer rights (for example, under the Consumer Rights Act 2015) sit with that seller, and vary depending on whether the source is a dealer, auction, or private sale. We will disclose to you what we know about a vehicle's condition and history at the point of purchase, to the best of our knowledge, but we do not guarantee the condition of any vehicle we help source, and we are not a party to the contract of sale.
We agree to act with reasonable care and skill in carrying out the sourcing service. Our liability to you is limited to loss arising directly from our own negligence in performing that service, and does not extend to defects in, or the condition of, any vehicle sourced, which is a matter between you and the seller.
You may collect a sourced vehicle yourself once all checks are complete, or delivery can be arranged at an additional cost agreed with you in advance.
You may cancel a commission at any time by telling us in writing. We reserve the right to charge for reasonable work already undertaken up to the point of cancellation, calculated fairly and explained to you at the time.
Any personal data you provide to us is handled in accordance with our Privacy Policy.

These terms are governed by the law of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
